Electricity at Work Regulations 1989

  • A written definition of which electrical tasks the maintenance operative may and may not perform, specifying that activities requiring technical knowledge (such as rewiring sockets, replacing light fittings, investigating tripping circuits, or opening appliances) are prohibited without appropriate qualification or supervision
  • A requirement for periodic inspection and testing of the fixed electrical installation by a competent electrician producing an Electrical Installation Condition Report (EICR), with specified intervals and a requirement that all C1 and C2 observations be remedied with records of completion
  • A risk-based inspection and testing schedule for portable and transportable electrical equipment (not a blanket annual interval), with higher-risk items (hoists, laundry equipment, wet-room appliances, continuously-running medical devices) inspected more frequently than lower-risk items (wall-mounted televisions)
  • A procedure for inspecting resident-owned electrical equipment on admission and periodically thereafter, including a process for addressing unsafe items that respects the resident's rights, capacity, best interests and dignity, with provision for discussion and safer substitutes rather than confiscation
  • A prohibition on daisy-chaining extension leads and use of multi-way adaptors, with a requirement to provide adequate fixed socket provision
  • Mandatory isolation and lock-off procedures before any work is performed on electrical systems or equipment, and a prohibition on live working except where all three limbs of the regulation 14 test are satisfied (which is stated to be essentially never justifiable in a care home)

Health and Safety at Work etc. Act 1974

  • Assigns clear health and safety duties to the employer/care provider to provide a safe working environment, safe systems of work, suitable equipment, proper training, supervision and adequate welfare facilities for staff
  • Assigns clear responsibilities to employees to take reasonable care for their own safety and that of others, follow training, use equipment correctly, and report hazards
  • Establishes a duty to protect residents (persons affected by the undertaking) under the same legal framework as staff protection
  • Requires risk assessments to be conducted, documented and regularly reviewed before incidents occur, covering all care activities including moving and handling, bathing, use of equipment, infection control, and resident mobility
  • Establishes that cost is not a valid defence for failing to implement safety measures unless the cost is grossly disproportionate to the risk being controlled
  • Specifies that the registered manager, nominated individual, and individual staff members can be held personally liable where offences result from their personal neglect or failures
