Control of Asbestos Regulations 2012
- Requires an asbestos survey to be carried out for any building constructed or refurbished before 2000, and must specify that a refurbishment and demolition survey (not just a management survey) is commissioned before any refurbishment or major building work begins
- Establishes and maintains an up-to-date asbestos register that records the location, type, and condition of asbestos-containing materials, and must specify the frequency of reviews and inspections of this register
- Requires that the asbestos register is made accessible to and consulted by all maintenance staff, contractors, tradespeople, and anyone carrying out work that may disturb building materials (including electricians, plumbers, decorators, IT contractors, and handymen) before any work commences
- Mandates asbestos awareness training for all in-house maintenance staff and any employees who may carry out minor building work, drilling, fixing, or alterations, and must specify that this training is refreshed at defined intervals
- Prohibits in-house maintenance staff from removing or working on asbestos-containing materials, and must require that licensed asbestos work is carried out only by HSE-licensed contractors with the appropriate notice period (fourteen days where required)
- Establishes a clear procedure for responding to accidental disturbance, damage, or discovery of suspected asbestos materials, including immediate work stoppage, area closure, prohibition of cleaning up debris, and mandatory reporting to a named responsible person

Health and Safety at Work etc. Act 1974
- Assigns clear health and safety duties to the employer/care provider to provide a safe working environment, safe systems of work, suitable equipment, proper training, supervision and adequate welfare facilities for staff
- Assigns clear responsibilities to employees to take reasonable care for their own safety and that of others, follow training, use equipment correctly, and report hazards
- Establishes a duty to protect residents (persons affected by the undertaking) under the same legal framework as staff protection
- Requires risk assessments to be conducted, documented and regularly reviewed before incidents occur, covering all care activities including moving and handling, bathing, use of equipment, infection control, and resident mobility
- Establishes that cost is not a valid defence for failing to implement safety measures unless the cost is grossly disproportionate to the risk being controlled
- Specifies that the registered manager, nominated individual, and individual staff members can be held personally liable where offences result from their personal neglect or failures
