Modern Slavery Act 2015
- Requires the organisation to ask each sponsored care worker, in writing and in their own language, what fees (if any) they paid to any agent or recruiter to obtain their job, and to whom those fees were paid
- Requires that the actual hours of work provided to sponsored workers match the hours stated in the Certificate of Sponsorship, and must prohibit the practice of promising full-time hours but providing significantly fewer
- Prohibits contractual clauses requiring workers to repay recruitment, training, or sponsorship costs if they resign within a specified period
- Requires that any passport or identity document taken from a worker for right-to-work checking purposes is returned to that worker immediately after the check is completed, and must prohibit retention of workers' documents
- Requires that where the organisation both employs a worker on a sponsored visa and provides or arranges their accommodation, the worker's continued access to that accommodation must not be made conditional on continued employment, and alternative arrangements must be documented if employment ends
- Requires due diligence checks on any employment agency used by the organisation, specifically requiring written confirmation that the agency does not charge fees to workers it supplies and does not retain workers' identity documents, and must include audit rights in agency contracts
